Japan signed the Hague Convention on the Civil Aspects of International Child Abduction in 2013, but problems for foreign – and Japanese parents – persist. An estimated 150,000 parents in Japan are refused access to their children every year, in violation of both Japanese laws and United Nations treaties, ratified by that Japan, that outlaw parental abduction. These parents say their children are the victims.

Last May, the US removed Japan from a list of countries "showing a pattern of noncompliance" with the Convention. But the US State Department said it remained "highly concerned about both the lack of effective mechanisms for the enforcement of Convention orders and the sizable number of pre-Convention abduction cases".

Tokyo-based Australian journalist Scott McIntyre hasn't seen his children since May last year. He was arrested on 28 November 2019 after gaining access - by following in a resident – to the apartment building where his parents-in-law live during his search for his children, who he says were taken by his wife. He spent all of December in detention and was tried in early January on a charge of trespassing. On 15 January he was sentenced to six months in prison, suspended for three year
